When you register as a User of our site we will ask that you provide us with information about your company, including your company’s, employer identification number and other related information. In addition, we will ask for the name, address, telephone and fax numbers, email address and related information for the main contact person for the account and people you may wish to include as additional contacts.

  
  

If you are a Client using our site to retain professionals, we may ask you to provide further information, including but not limited to your skill requirements, and financial and other business related information. If you are a Vendor using our site to offer your professionals’ services, we may ask you to provide information about your professionals’ skills and prior educational and employment history, including but not limited to resume information. We use this information to process your requests and facilitate the bidding, selection and billing processes.

  
  

If you are a Vendor who offers a consultation service organized through our site, your professionals will be required to provide information about the services they provided, including timesheets and other supporting documentation. We will transfer this information to the Client’s manager for approval. This information is used as part of our billing process, and its kept confidential. The information would only be available to the parties to the consultation agreement and SkillBay.

  
  

When you visit our site, we collect certain routing information such as the Internet Protocol ("IP") address of the originating computer, and information provided by "cookies." The IP address is used to help diagnose problems with our server and to administer our web site. The cookie sets a session identifier and contains some programming variables. Our cookies are small data files made up of a string of text and numbers which do not contain any personal information. Finally, we collect aggregate information about the use of our site, such as which pages are most frequently visited, how many visitors we receive daily, and how long visitors stay on each page.

The information we collect about you is used to process Client requirements and Vendor bids, to provide you with information about your bids or requirements, open interview schedules, to bill and pay for services, to notify you of updated information, changes to our site, new products and services that we believe might be beneficial to your business, and for related transactions. We may also combine information you have provided to us in prior communications offline with the information you have given us online, to provide a more customized experience for you when you visit our site.

  
  

We use unique identifiers, such as your company’s employer identification number, along with financial and other business information provided by you to check your qualifications for registration, verify your identity and process billing.

  
  

We use demographic and site usage information collected from visitors to improve the usefulness of our site and to prepare aggregate, non-identifying, information used in SkillBay’s marketing, site advertising, or similar activities.

We will not reveal the contents of individual resumes supplied by Vendors except for the respective Vendors’ own review and when this information is required for a post-bidding placement interview. When bidding closes, we will email the resume data of the professional(s) to the Client who had posted the requirements and allow that Client to access the resume data through this site for browsing or printing at the Client’s facility.

  
  

In addition, we may provide aggregate statistics about our customers, placements, financial statistics and site activity for purposes of marketing or promotion.

  
  

We may disclose information about you if we have a good faith belief that we are required to do so by law or legal process, to respond to claims, or to protect the rights, property or safety of SkillBay or others.

  
  

Other companies that provide services on our site, provide a co-branded version of our site, or advertise or have links on our site, may use cookies or collect other information about you when you go to their site. SkillBay does not control the collection or use of information by these companies. Your transmission of sensitive data, including financial information, through our site is secured through international-grade Secured Socket Layer (SSL) encryption. Likewise, all operational business transactions, including all Vendor resumes and Client requirements submitted through the site, and billing information and account status information accessible through the site, are secured via SSL encryption. However, information sent to or from SkillBay via e-mail is not encrypted. SkillBay is not responsible or liable for the use or disclosure of information provided to third-parties. Your account information hosted on SkillBay will only be accessible with your account’s authorized user names and passwords.

  
  

While SkillBay strives to protect your personal or company information by encryption, user names and passwords, application-level security measures, data base security measures and by other means, it cannot guarantee or warrant the security of the information you transmit to us, and if you choose to use our site, you do so at your own risk.

  
  

Please keep in mind that the information disclosed by you on our site – for example, information you may provide to others during a NetMeeting interview or on forums open to the public that may be available on the site – can be collected and used by other vendors of the online community or visitors to the site.

If you are an individual resident in a Vendor State of the European Union, you acknowledge and agree that SkillBay may collect, use and disclose your personal data that you transmit on or through this site or as otherwise described in the SkillBay Privacy Policy, or any amendments hereto. Such data will be stored on servers located in the United States which may have less stringent privacy practices than in your resident country. You further acknowledge and agree that SkillBay may transfer your personal data outside of the European Union or to other businesses or for purposes of processing your requests or providing our service or for other business purposes. You can review the registration information you have provided to us at any time by accessing the Account Maintenance page on this Web site, and you can easily change or delete any of your registration information as appropriate.
